What is a NOICC?
Notice of Intention to Consider Cancellation (NOICC) is a letter from the Department of Home Affairs that formally notifies you that they are considering cancelling your visa — but not immediately.
This is your opportunity to explain your circumstances, defend your stance on your visa, and show supporting documentation before your final decision.
If you have received a NOICC, you'll need to act quickly — you may have only 7 days to do so.
Why Was I Given a NOICC?
A NOICC may be ordered for a variety of reasons, such as:
- Breaches of visa conditions (i.e., illegal work or overstay)
- Noncompliance with standards of character under Section 501
- Providing wrong or false information
- Changes in your circumstances that impact your visa eligibility
- Health or safety concerns
The letter will outline the concerns of the department and ask you to submit a written response before they make a decision on whether your visa can be revoked.
Don't Ignore It — How Getting It Right Can Save Your Visa
This is not a procedural issue; your response is your statutory right to present your case for your right to stay in Australia. A concise, clear, and cogently argued response can be the deciding factor in having your visa continued or cancelled.
Yet, stress is not laid on providing merely the right statements; instead, one needs to properly present these assertions, with proper evidence, wordage, and organizational layout.
